Terms & conditions
I. Scope of Application
1. These General Terms and Conditions (GTC) apply to contracts between BB Gastgeber GmbH, Fischerstraße 19, 87435 Kempten, as operator of Hotel BergBuddies Oberjoch, Paßstraße 36, 87541 Bad Hindelang – Oberjoch (hereinafter referred to as “Operator”, “Hotel”, “we” or “us”) and the customer regarding the temporary rental of hotel rooms, conference, banquet and event facilities, as well as all related additional services and deliveries (“Hotel Accommodation Contract”).
2. These GTC apply exclusively. The customer’s terms and conditions shall only apply if expressly agreed with the Hotel in text form.
3. The contract language is German.
II. Conclusion of Contract and Contract Content
1. Offers made by the Hotel are non-binding. A contract is concluded upon acceptance by the Hotel. The Hotel may confirm the booking in writing or in text form. Electronic contracts are governed by Section III.
2. Subletting or further renting of rooms, event spaces or areas, or use for job interviews, sales events or similar purposes requires prior written consent of the Hotel. Section 540 (1) sentence 2 German Civil Code (BGB) is waived unless the customer is a consumer within the meaning of Section 13 BGB.
3. The customer has no entitlement to specific rooms. Check-in is from 3:00 pm unless otherwise agreed. Rooms must be claimed by 6:00 pm unless a later arrival is agreed.
4. Check-out is by 11:00 am. Late check-out until 6:00 pm may be charged at 50% of the full room rate; after 6:00 pm at 90%. The customer may prove lower damage.
5. Hotel facilities may only be used during opening hours. The Hotel reserves the right to change hours or close facilities.
III. Online Booking Form
1. The online booking form constitutes an invitation to submit an offer. The contract is concluded once booking confirmation is sent by email within two working days.
2. Inquiries by mail, email, fax or contact form are non-binding. The Hotel may submit a binding offer valid for five days.
3. The booking confirmation contains the contract text including GTC. The contract text is stored temporarily and is no longer accessible online after booking. Data processing details are found in the Privacy Policy.
4. The customer must ensure email delivery is technically possible.
IV. Prices, Payment, Services
1. The customer must pay agreed prices including VAT unless otherwise stated.
2. If more than four months pass between contract and performance, and prices or VAT increase, the Hotel may increase the price up to 10%. Reminder fees of €5.00 may apply.
Product images are illustrative. Food products may vary naturally. Buffets are limited to three hours for hygiene reasons.
3. Billing is in Euro. Currency differences are borne by the payer.
4. Invoices are payable immediately upon receipt.
5. The Hotel may request advance payments. Group and event deposits are structured as specified (e.g., staged percentage payments before arrival).
6. The invoice recipient must be communicated at the latest at departure.
7. Invoice complaints must be submitted within 3 days.
8. Pets require prior approval and fee. Unregistered pets may incur a €300 cleaning fee.
9. VAT adjustments may require price changes.
V. Withdrawal by the Hotel
The Hotel may withdraw if advance payments are not made or for justified reasons (force majeure, misleading booking details, threat to business operations, etc.). No compensation claim arises.
VI. Cancellation by the Customer
1. Cancellations must be made in text form.
2. Individual bookings (up to 10 rooms): free cancellation up to 21 days before arrival; thereafter 80% of total price applies.
Group bookings follow Bestprice or Flexi rate cancellation structures with graduated percentages depending on timing.
Exclusive bookings (24 rooms): no reduction allowed 90 days prior; unused rooms charged at full rate minus breakfast.
3. Late arrival or early departure counts as cancellation.
4. The customer may prove lower damage; the Hotel may prove higher damage.
VII. Changes in Participant Numbers / Event Times
Guaranteed participant numbers must be provided 48 hours prior. Deviations beyond 5% may be charged. Events may incur surcharges after 1:00 am (€375/hour). Room changes may occur if reasonable.
VIII. Technical Equipment
The Hotel may procure third-party equipment on behalf of the customer. The customer is liable for proper use and return.
IX. Decorations and Items Brought by Customer
No wall attachments allowed. Items must be removed immediately after event. Food/drink brought in requires written agreement (corkage may apply).
Pyrotechnics and drones are prohibited unless expressly approved with valid insurance proof.
The customer is responsible for necessary permits and third-party rights (e.g., GEMA).
X. Liability of the Hotel
Liability is excluded except in cases of intent, gross negligence, or essential contractual obligations. Liability for life, body, health remains unaffected.
Hotel liability for guest property is limited under Sections 701 ff. BGB.
Parking spaces do not create custody agreements.
Lost property is stored for six months.
XI. Liability of the Customer
The customer is liable for damages caused by themselves or persons under their responsibility and must ensure adequate insurance coverage.
XII. Online Dispute Resolution
The EU Online Dispute Resolution platform is available at:

The Hotel is not obliged to participate in dispute resolution proceedings.
XIII. Final Provisions
1. Amendments must be in text form.
2. Place of performance and payment is the Hotel’s registered office.
3. Place of jurisdiction is the Hotel’s registered office if the contractual partner is a merchant.
4. German law applies, excluding UN Sales Law.
5. If individual provisions are invalid, remaining provisions remain valid.
